This Statement of Privacy applies to our practices in connection with the Platform, i.e. application available at PlayStore and AppStore and website at www.bharatmed.ai Protecting your private information is our priority. This Privacy Policy describes the treatment of information collected and posted on the Application.

The Company fully respects your right to privacy and would like to safeguard the information you provide to the Company and will not use or collect any personal information on this Application without your permission. Any Personal information which you voluntarily submit/provide to the Company will be treated with the highest standard of security and confidentiality and shall be used strictly for the purposes of the services provided by the Company and Application only. By using the Application, you consent to the data practices described in this statement.

By using the Application, you signify your agreement to the terms of this Privacy Policy and the Company reserves the right, in its sole discretion to change, modify, add and/or delete portions of the terms of this Privacy Policy at any time with immediate effect of such change.

• Collection and Use of your Personal Information

  BharatMed collects Data for various purposes set out in this Privacy Notice. This Data includes, without limitation, the following categories:

  • Contact information: first and last name, email address, postal address, country, employer, phone number and other similar contact data.
  • Financial information: payment instrument information, transactions, transaction history, preferences, method, mode and manner of payment, spending pattern or trends, and other similar data
  • Technical information: website, device and mobile app usage, Internet Protocol (IP) address and similar information collected via automated means, such as cookies, pixels and similar technologies.
  • Transaction information: the date of the transaction, total amount, transaction history and preferences and related details.
  • Health related information, such as information or records relating to Your medical/ health history, health status, details of treatment plans and medication prescribed by a Medical Practitioner, dosage details such as frequency of dosage, alternative medication, medicines ordered by You through the Platform, laboratory testing results and any other information inferred there from
  • Product and service information: Your account membership number, registration and payment information, and program-specific information, when you request products and/or services directly from us, or participate in marketing programs.
  • Personal information: Age, sex, date of birth, marital status, nationality, details of government identification documents provided, occupation, ethnicity, religion, travel history or any other personal information provided in responses to surveys or questionnaires.
  • Your reviews, feedback and opinions about our products, programmes and services.
  • Loyalty programme information: your loyalty membership information, account details, profile or password details and any frequent flyer or travel partner programme affiliation.
• The Company will use the personal data which you have provided to the Company for the purposes of fulfilling your application for any of the Company"s services and products, credit checks in the case of applications, and for understanding how the Company can improve its services to you. Where appropriate, the Company may also use the information for internal research on the Company's user demographics, interests and behaviour, for providing you with the latest updates, where the Company thinks you may be interested in its services and/or services of some of the Company's affiliates or third parties. The Company may combine personal information collected from you with information from other services or third parties to provide a better user experience, that display customized content and advertising including customizing content for you. The Company requires the compliance of its Privacy Policy where the Company hires third parties for aid and assistance in case of upgradation of the Company's research and analysis, and technological advancement. The Company may also share the information with any third party, in limited circumstances, for national security and integrity or on an order from any court of law or competent authority. The Company may store sensitive information (including without limitation banking information, transactions, credit card/debit card/UPI details, government identity proof, etc.) using encryption for data-processing for the purposes of validation and verification of such information.
• We receive information through other people/third party service providers/third party services/ third party servers upon your/our use of such third-party services or your interaction with other people, which may include information about your phone number from their mobile address book; reports to help us diagnose and fix service issues. Please note that when you use third-party services, their own terms and privacy policies will govern your use of those services.
• The Company will also use your Internet Protocol address and e-mail addresses to help diagnose problems with the Company"s server and to administer the Application. If you don't want your personal information to be displayed to third party visitors you need to contact the Company in that behalf. Please remember that any information that is disclosed in the public areas of this Application becomes in fact public and you should exercise caution when deciding to post your personal data.
• The Company's primary purpose in collecting information from you is to allow you to use the Application and various features and services made available on or in relation to the Application or any Applications or for any services provided by the Company or its affiliates or its various service providers or business partners and advertisers; to record your information and details as permitted and required under applicable laws, statutory direction or judicial orders; to serve various promotion materials and advertising materials to you; and such other uses as provided in this Privacy Policy. The Company may also use your information for content recommendations, transactional emails or to provide you with information, direct marketing, online and offline advertising and other materials regarding products, services and other offers from time to time in connection with the Company or its parent, subsidiary and affiliated companies and its joint ventures.
  • The Company may further use your information for carrying out Our obligations arising from Your requests for the products and Services on the Application; operating and improving the Application in order for a positive user experience and to improve Our business as a whole; processing and delivering Your order with Us; enabling Your access to Our Application to purchase products and provide Services; analysing data, tracking trends, building algorithms, creating databases for rating systems, recommendations engines, etc.; research, growth and development of our business including building upon our network of our pharmacists, retailers, consulting doctors, partners etc.; responding to Your requests, customising Your orders, improving Our Application or communicating with You; frequency capping, compliance, billing, ad reporting or delivery, market research or product development purposes; complying with applicable law; conducting audits and quality assessment procedures; improving our services or product offerings through marketing and promotional efforts to customize Your experience; analysing the use of Our resources, troubleshooting problems and improving Our Products and Services, by using the information regarding Your mobile device and software; contacting users, both during and after an order, for updates, resolution of queries, order details, consultations, follow-up consultations or offering new products or services; investigating, preventing, or taking action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of Our Terms, or as otherwise required by law; responding to any queries that You may have, and to communicate information to You, including notifications of any promotions or alerts, any changes/updates to the Application; processing payments or contact You, by way of SMS, email and phone calls, from time to time to record Your valuable feedback on Our Products and Services at all times.
• We may access or store Your information if it is necessary to detect, prevent or address fraud and other illegal activity or to protect the safety, property or rights of the Application or others.
• The Company may further share Your information with third-party service providers for delivering packages, sending postal mail, newsletters and e-mail, removing repetitive information from customer lists, analysing data, providing marketing assistance, providing search results and links (including paid listings and links), processing card payments and providing customer service. The tools used by such third party service providers to provide the Services, may also collect Your personal information during the process of providing such Services. Further, such third-parties shall process the personal information in accordance as permitted by applicable law. It is clarified that the Company will not be responsible and liable for the acts of omissions and commissions of such third parties associated with Us.
• We may use information regarding Your location or the location of Your device through which You access the Service for a number of purposes, including without limitation to confirm You are located in a jurisdiction in which the Service is offered and to identify an appropriate Pharmacist for timely delivery.
• We may collect, analyze, use, publish, create and sell de-identified information, of which Your personal or sensitive personal information might be a component, for any business or other purpose not prohibited by applicable law, including for research and marketing purposes.
• You can decide not to participate in the promotion if you do not want your data to be shared. Promotions that run on the Application may be sponsored by companies other than the Company or may be co-sponsored by another company. Some or all data collected during a promotion may be shared with the sponsor.
• Additionally, the Company further states that the Company tracks down some traffic data. Each time a visitor comes to the Application, the Application's server logs some basic technical information such as browser and Application, visitor's domain name, referral data, etc. The Company is also processing the visitor's activity through the Application. Also, the Company uses third-party advertising companies to serve ads when you visit the Application. These companies may use information (including your name, address, email address, or telephone number) about your visits to this and other Applications in order to provide advertisements about goods and services of interest to you.
• The Company may also collect information required for providing You Services on the Application including, items You place in the cart, Products You may order, etc. You can choose not to provide certain information, but then You may consequently not be able to make use of the enhanced Application functionality.
• We may also collect sensitive personal data or information about You when You use the Service(s) on the Application. This information includes health information We receive from You or, on Your behalf, such as information or records relating to Your medical or health history, health status and details of medical practitioner issuing the prescription, details of treatment plans and medication prescribed by a medical practitioner, dosage details such as frequency of dosage, alternative medication, medicines ordered by You through the Application, diagnostic results, other health-related information and any other information inferred therefrom. We may also collect payment information such as Your payment card number, expiration date, billing and shipping address. By using the Service, You consent to the recording, storage, and disclosure of such communications You send or receive for these purposes. We may also store and process prescriptions, treatment notes, recommendations and other data generated by Medical Practitioners on or through the Application, and data shared by third parties such as diagnostics related information; prescription related information etc and may retain such material for Our records for the duration of You availing the Services or for any such period required or permitted under applicable law.
• We may share your Data with/ for:
  • Partners: We may make available to you services, products, or applications provided by Partners for use on or through our website or mobile application. If you choose to use such service, customer information related to those transactions may be shared with such Partner. Such Partners will be required to respect the security of your Data and to treat it in accordance with this privacy policy and applicable law.
  • BharatMed Consumer Platform: Your Data may be shared with BharatMed and other participating entities on the BharatMed Consumer Platform operated by BharatMed for purposes of enrolment, offering you products, services and benefits. Accordingly, we may share your Data with other BharatMed Partners and Service Providers and as a part of this unification your account information across several companies may be merged, to offer You a single login for seamless experience.
  • Service Providers: We may share your Data with Service Providers. Examples include storing and analyzing Data, protecting and securing our systems, providing search results and links, providing customer service, credit analysis, processing your information for profiling, user analysis and payment processing.
  • Information from Other Sources: We may obtain information from other sources. An example of this is when you authorize a third-party website to interact directly with our website or mobile application to provide or receive Data about you. In that case, we might receive such Data used by that third-party website to identify your account with that website. These Service Providers will be required to only process Data in accordance with express instructions and as necessary to perform services for purposes set forth in this Privacy Notice. The Service Providers will also be required to safeguard the security and confidentiality of the Data they process by implementing appropriate technical and organizational security measures and confidentiality obligations binding employees accessing Data.
  • Business Transfers: As we continue to develop our business, we might sell or buy subsidiaries or business units. Your Data (including in relation to loyalty programs) may be transferred as part of such transaction. Any Data that we receive from a third party pursuant to such transactions will be processed in accordance with this Privacy Notice and applicable law.

  • Location Data Collection for Pickup and Delivery Address
    • The BharatMed Application collects location data from the user's phone to streamline the pickup and delivery process. By accessing the device's GPS capabilities, the Application accurately captures the user's current location, ensuring precise pickup and delivery address information. This enables seamless and efficient order creation, ensuring that the delivery service can promptly and accurately reach the designated locations.
  • Permission Requirements for Enhanced Application Functionality
    • SMS (Short Message Service): The Application may request permission to access SMS functionality to automatically retrieve verification codes or important order-related messages, ensuring a seamless user experience during the verification and communication process.
    • Phone: The Application may request permission to access the phone functionality to enable direct calling for customer support or driver-customer communication, facilitating efficient and effective communication between all parties involved in the delivery process
    • Audio Recording: The Application may request permission to access the device's microphone to enable audio recording for voice-based interactions, such as recording notes or capturing verbal instructions during delivery pickups and drop-offs. This feature ensures accurate and convenient communication between users and delivery personnel.
    • Media Storage: The Application may request permission to access the device's media storage to save and retrieve essential data related to order history, receipts, or user-generated content (such as photos for proof of delivery). This permission allows for seamless storage and retrieval of relevant information within the Application.
    • Rest assured that all requested permissions are solely utilized to enhance the Application's functionality and provide a smooth and efficient delivery experience. BharatMed prioritizes user privacy and data security, ensuring that collected data is handled responsibly and in compliance with applicable privacy laws and regulations.
• Compliance with Laws
  • The Company co-operates with mandated government and law enforcement agencies or to any third parties by an order under law for the time being in force to enforce and comply with the law. The Company will also disclose any information about you to the government and law enforcement agencies or private parties without your permission as the Company, in its sole discretion, believes it to be necessary or appropriate to respond to valid claims and legal processes, to protect the property and rights of the Application or a third party, to protect the safety of the public or any person, or to prevent or stop any illegal, unethical or legally actionable activity. The Company may also provide your information to various tax authorities upon any demand or request from them
  • Unfortunately, no data transmissions over the internet can be guaranteed to be completely secure. As a result, while we strive to protect your personal information, the Company cannot ensure or warrant the security of any information you transmit to the Company via the internet, and you do so at your own risk. Once the Company has received your transmission, the Company will use its reasonable endeavour to ensure its safety & security on the Company's systems. Nothing contained in this policy is intended to create a contract or agreement between the Company and any user providing identifiable information in any form.
  • We will take necessary steps to comply with this Privacy Policy; however, to the extent permitted by law, nothing in this policy is intended to hold the Company liable for any failure to comply with this Privacy Policy.
• Data Retention
  • We will retain your information for as long as it is necessary to provide you the services available on the Application. Post termination of your account, we may continue to use your anonymized data aggregated or in combination with anonymized data of other users. We use this aggregated anonymized data for data analysis, profiling and research purposes. We may keep your contact information along with your application details (if any) for fraud prevention purposes and for the exercise/ defense of a legal claim or for providing evidence in legal proceeding(s).
• Opt-Out
  • If you are no longer interested in sharing your personal information, please e-mail your request at: [email protected]. Please note that it may take about up to 7 business days to process your request or disabling our services on the Application.
• Termination
  • Termination of Your Account may include: (i) removal of access to all offerings within the Application or with respect to the services; (ii) deletion of Your materials and Account Information, including Your personal information, log-in ID and password, and all related information, files and materials associated with or inside Your Account (or any part thereof); and (iii) barring of further use of the Services.
