Welcome to BharatMed, a technology platform that connects local retail pharmacies with customers. The following terms and conditions (the "Terms") govern your access to and use of the BharatMed app (the "App"), so please read them carefully before using the App. By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.
BharatMed is an e-commerce technology platform that allows local retail pharmacies to list their pharmacy products and allows customers to purchase from these listings.
You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are 18 years of age or older.
In order to use certain features of the App, you may need to register for an account. You agree to provide accurate and complete information when creating your account and to keep your account information up-to-date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
BharatMed does not sell any products directly. Instead, local retail pharmacies list their products on the App and customers can purchase from these listings. BharatMed does not guarantee the accuracy, completeness, or quality of any product listing. Customers are solely responsible for verifying the accuracy and suitability of any product before making a purchase.
BharatMed does not provide delivery services directly. Instead, customers may choose to have the product delivered by the local retail pharmacy or may arrange for their own delivery. BharatMed is not responsible for any delivery-related issues or disputes that may arise.
BharatMed does not process payments directly. Instead, payment is processed by third-party payment processors, and the terms and conditions of those payment processors will apply to any transactions you make through the App.
You agree to use the App only for lawful purposes and in a manner that does not infringe the rights of others. You may not use the App in any way that could damage, disable, overburden, or impair the App or interfere with any other user's use of the App. You may not use any automated means, such as robots or spiders, to access the App.
The App and all content and materials included on the App, including but not limited to text, graphics, logos, images, and software, are the property of BharatMed or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or display any portion of the App or its content without the prior written consent of BharatMed.
The App is provided on an "as is" and "as available" basis, without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or title. BharatMed does not warrant that the App will be error-free or uninterrupted.
BharatMed will not be liable for any damages of any kind arising from the use of the App, including but not limited to direct, indirect, incidental, punitive, and consequential damages. In no event will BharatMed's total liability to you for all damages, losses, and causes of action arising out of or related to these Terms or the App exceed the amount paid by you, if any, to BharatMed.
Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the App, to understand our practices regarding the collection and use of your information.
BharatMed reserves the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on the App. Your continued use of the App after such modifications constitutes your acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.
